TERMS AND CONDITIONS OF INTERNET STORE WWW.ESUS-IT.COM OF 11.04.2013  
 
 
I. Definitions 
 
The terms used in the Terms and Conditions mean: 
 
1. Client – a natural person, a legal person or an organizational unit that is not a legal person with special provisions granting legal capacity to make an order within the store; 
 
2. Civil Code – the Polish Civil Code Act of 23 April 1964, as amended; 
 
3. Terms and Conditions - these Terms and Conditions of Electronic Services in the Online Store esus-it.com; 
 
4. ESUS IT online store – the online store available at www.esus-it.com, where the Buyer may place an order; 
 
5. Goods - products presented at the Online Store; 
 
6. Sales Agreement - contract for the sale of Goods within the meaning of the Civil Code, concluded between ESUS IT Aleksandra Drobinska and the Customer, concluded by using Online Store; 
 
7. Electronic Services Act - Act of 18 July 2002 on providing services by electronic means (Journal of Laws No. 144, item 1204, as amended); 
 
8. Order - the Buyer's declaration of will, leading directly to conclusion of Sales Agreement, specifying in particular type and quantity of the goods. 
 
II. General provisions 
 
2.1. These Terms and Condtions set out the rules for using the online store available at www.esus-it.com. 
2.2. Terms and Conditions are the regulations referred to in art. 8 of the Act on the Provision of electronic services. 
2.3. The online store, www.esus-it.com, run by "ESUS IT Aleksandra Drobińska", based in Szczecin, ul. Somosierry 30A entered into the register of entrepreneurs, led by the President of the City of Szczecin under the registration number P/065153/11, VAT No. PL6721927664, REGON 320539978 called below seller. 
2.4. These Terms & Conditions specify in particular [depending on available options]: 
a.) The rules for registering account and using Online Store; 
b.) The terms and conditions for electronic reservation of products available at the online store; 
c.) Terms and conditions for electronic submission of Orders within the online store; 
d.) Rules for concluding Sales Agreements using the services provided within the Online Store. 
2.5. Using the online store is possible provided that the system used by Client meets the following minimum technical requirements: 
a.) Internet Explorer version 7.0 or newer; 
b.) Mozilla Firefox version 11.0 or newer; 
c.) Google Chrome version 19.0 or newer; 
d.) Opera version 9.0 or newer; 
e.) Minimum screen resolution 800 x 600 pixels. 
2.6. In order to use the online store, the customer should have access to a computer station or terminal, with access to the Internet. 
2.7. Under applicable laws, the Seller reserves the right to limit the provision of services through the Online Store to persons over the age of 18. In this case, potential customers will be notified of the above.

2.9. Informations about the Goods available at the store’s website, in particular their descriptions, technical and functional parameters and prices, constitute an invitation to conclude an agreement, within the meaning of Article 71 of the Polish Civil Code. 
 
III. Terms of Use of the Online Store 
 
3.1. In order to start using the Internet Store, you must go to www.esus-it.com. 
3.2. You do not need to register to make a purchase. 
3.3. Registration is made by completing and accepting the registration form available on one of the Store pages. 
3.4. Condition of registration is to agree to the content of the Terms and Conditions and provide personal data marked as mandatory. 
3.5. The Seller may deprive the Customer of the right to use the Internet Store and may limit its access to some or all of the resources of the Online Store, with immediate effect in case of Client’s violation of Terms & Conditions, particularly when Client: 
a.) provided during the registration in the online store data that is not true, inaccurate or out-of-date, misleading or violating the rights of third parties, 
b.) committed through the Online Store to infringement of the personal rights of the third parties, in particular the personal rights of other customers of the Online Store, 
c.) to engage in other behaviours that will be considered by the Seller to be a behaviour inappropriate with the applicable laws or general principles of using the Internet or harming the good name of the Seller. 
3.6. A person who has been deprived of the right to use the online store cannot re-register without the seller's prior consent. 
3.7. In order to ensure the safety of the transmission of messages and data in connection with the services provided within the Site, the Online Store shall take technical and organizational measures appropriate to the security risk of the services provided, in particular measures to prevent the unauthorized access and modification of personal data transmitted on the Internet. 
3.8. The client is obliged in particular to: 
A.) Not to submit or not transmit content prohibited by law, such as content promoting violence, defamation or infringement of personal rights and other rights of third party, 
B.) Use the Online Store in a way that does not interfere with its operation, in particular by using specific software or hardware, 
C.) Not to take action such as sending or posting unsolicited commercial information (spam) within the Online Store; 
D.) To use the Online Store in a manner that is not inconvenient for other customers and for the seller, 
E.) Use of any content contained within the Online Store solely for your personal use, 
F.) Use of the Internet Store in a manner consistent with the Polish law, the provisions of the Terms and Conditions, as well as the general rules of using the Internet. 
 
IV. Procedure of concluding the Sales Agreement 
 
4.1. In order to conclude the Sales Agreement through the Online Shop, please visit www.esus-it.pl, select the appropriate product or products, take further technical steps based on the displayed messages and the information available on the website. 
4.2. The choice of ordered goods by the Customer is made by adding them to the cart. 
4.3. When ordering - until the "I order" button is pressed - the customer has the opportunity to modify the entered data and to select the Goods. For this purpose, you should follow the displayed messages and information available on the website. 
4.3.1 Personal data shared with us is safe. Our Privacy Policy is fully compliant with GDPR – more details in the Privacy Policy. 
4.4. Once the Customer using the Web Store has given all the necessary data, a Summary of the Order is displayed. The summary of your Order will include information about: 
A.) The subject of the order, 
B.) Unit and total price of ordered products or services, including delivery costs and additional costs (if any); 
C.) Selected payment method, 
D.) The selected delivery method, 
E.) Delivery time, 
4.5. In order to send the Order, it is necessary to accept the content of the Terms and Condtions, provide the personal information marked as mandatory and press the "Place an Order" button. 
4.6. Sending the Order by Customer is a statement of will to conclude a sale agreement with the seller, in accordance with the Terms and Conditions. 
4.7. After submitting the Order, the Customer receives an email entitled "ESUS IT - Confirming Not Receiving Order (Buyer's Login)", which contains the final confirmation of all relevant elements of the Order. 
4.8. The agreement is treated as concluded when the Customer receives the email mentioned above. 
4.9. The sales contract is concluded in Polish, with the content in accordance with the Terms and Conditions. 
 
V. Delivery 
 
5.1. Delivery of Goods is not restricted to the territory of the Poland and takes place at the address indicated by the Client during the Order submission. Countries we carry out shipping to: 
Poland, Austria, Belgium, Croatia, Czech Republic, Denmark, Estonia, Finland, France, Greece, Germany, Hungary, Italy, Liechtenstein, Luxembourg, Latvia, Netherlands, Ukraine, United Kingdom 
5.2. Delivery of ordered goods takes place by courier or by Polish post. For information on shipping costs, visit the Delivery and Payment page. In addition, delivery costs will be indicated at the  Order form. 
5.3. The shipment of the order is carried out according to the customer’s specification, while the Seller will take all necessary steps to complete the order as quickly as possible. Shipments are made according to the following rules: 
5.3.1. Shipping inPost courier is held until 1PM every working day, however the delivery method will not be changed. Orders made after 1PM are sent the next business day. 
5.3.2. Shipping by UPS and DPD couriers is held until 3PM every working day. After 3PM, the Seller will attempt to contact the Client in order to determine the possibility of changing the carrier. After three phone call attempts, the Seller decides to send shipment on the next business day. 
5.3.3. Other available delivery methods (priority registered letter, Pocztex, Paczkomaty 24/7) are sent on the same business day by 4PM. 
5.4. Customers may access these Terms and Conditions at any time via the link on the main website www.esus-it.com and download and print it. 
Consolidation, security, disclosure and confirmation of the essential provisions of the Sales Agreement for the sale of Goods to the Client, takes place by sending a confirmation printout, order specification and VAT invoice to the e-mail address provided by the Client and inside the package with the goods. 
 
VI. Prices and payment methods 
 
6.1. Commodity prices are quoted in Euro and include all costs, including VAT (with rate distinction), customs and all other components. 
6.2. The customer is able to pay by: 
A.) Bank transfer to bank account number Bank Zachodni WBK S.A. 03 1090 2662 0000 0001 0956 0762 (IBAN PL03 1090 2662 0000 0001 0956 0762), 
B.) Payments in the system http://www.payu.pl/, PayPal, IAI payments supporting the following banking systems: 
Mastercard, Visa, Visa Electron; 
C.) Payment by credit card 
D.) Cash on delivery. 
 
VII. Right to withdraw from the contract

VIII. Claims on Goods (Warranty) 
8.1. The seller is liable to the consumer being a consumer within the meaning of art. 22 [1] of the Civil Code, in respect of defects in the scope of the Civil Code, in particular art. 556 and Art. 556 [1] -556 [3] of the Civil Code. 
8.2. Complaints arising from violation of the rights of the Client, which are legally guaranteed, or pursuant to these Terms and Conditions, should be addressed to: sklep@esus-it.pl. The Seller undertakes to consider each complaint within 14 days, and if it is not possible, to inform the Customer within that time when the complaint will be processed. 
8.3. The seller is not the manufacturer of the goods. The manufacturer is liable under the guarantee of the goods sold under the terms and for the period indicated in the warranty card. If the warranty document provides such an opportunity, the customer can claim his / her warranty claims directly at an authorized service centre whose address is included in the warranty card. For some goods (such as frame memory), a warranty card is not issued. The warranty is based on a guarantee seal in memory with the date of expiry of the warranty. Items with damaged warranty (broken, broken or blurred) are not subject to a complaint. 
 
IX. Complaints regarding the provision of services by electronic means 
 
9.1. The Seller shall take steps to ensure that the Store is fully operational, to the extent that it is based on current technical knowledge and undertakes to remove, within a reasonable time, any irregularity reported by the Customer. 
9.2. The Client shall immediately notify the seller of any irregularities or interruptions in the operation of the Internet Shop. 
9.3. Irregularities related to the functioning of the Store Customer may submit by mail to the

9.4. In the complaint, the Customer should provide his / her name, mailing address, type and date of the malfunction related to the functioning of the Store. 
9.5. The Seller undertakes to consider each complaint within 14 days, and if it is not possible, to inform the Customer within that time when the complaint will be processed. 
 
X. Final provisions 
 
10.1. Settlement of any disputes arising between the seller and the client, who is a consumer within the meaning of art. 221 of the Civil Code, shall be subjected to the competent courts in accordance with the provisions of the relevant provisions of the Code of Civil Procedure. 
10.2. Settlement of any disputes arising between the seller and the customer who is not a consumer within the meaning of art. 221 of the Civil Code of the Civil Code, it is subjected to the court having jurisdiction over the seat of the seller. 
10.3. In matters not covered by these Regulations, the provisions of the Civil Code, the provisions of the Act on the provision of electronic services and other relevant provisions of Polish law shall apply.
